1. Who we are and what these terms cover

This website, www.dynamicwhale.com (the "Website"), is operated by DynamicWhale B.V., registered with the Dutch Chamber of Commerce under number 96714395, with its registered office at Stadhuisplein 9, Unit 5.10, 3012 AR Rotterdam, the Netherlands.

These terms apply to everyone who visits or uses the Website. By using it you accept them. They do not govern the services we provide to clients: those are covered by the services agreement signed with each client. The DynamicWhale Client Portal at app.dynamicwhale.com has its own Terms of Service.

2. Using the Website

You may use the Website to learn about DynamicWhale, read our content, contact us and apply for roles. You agree not to:

• use the Website in a way that breaks the law or infringes anyone's rights,

• probe, scan or test the security of the Website or try to gain access to systems or data that are not meant for you,

• copy the Website or its content by automated means such as scraping or crawling, other than by public search engines indexing it,

• send us unlawful, defamatory, infringing or malicious material, including through the contact form,

• interfere with the Website or overload it.

3. Content and intellectual property

The Website and everything on it, including text, design, logos, images, case studies and code, belong to DynamicWhale or to the people who licensed them to us and are protected by copyright and trademark law. You may view the Website and print or download extracts for your own reference. You may not otherwise reproduce, distribute or use our content commercially without our written permission.

Names and logos of clients and partners shown on the Website belong to those companies. Their appearance does not mean they endorse the content of the Website beyond the case study or quote they have agreed to.

4. Information on the Website

We try to keep the Website accurate and up to date, but it is provided for general information only. Case studies describe results achieved for particular clients in particular circumstances and are not a promise of results for anyone else. Nothing on the Website is legal, financial or professional advice, and nothing on it is an offer that can be accepted to form a contract. Any engagement with DynamicWhale is subject to a signed agreement.

5. Contacting us and applying for roles

When you contact us through the Website we will use your details to respond, as described in our Privacy Policy. Please do not send us confidential information through the contact form; we cannot treat information as confidential until an agreement is in place. Job applications are handled as described in the Privacy Policy and do not create any obligation on us to interview or hire.

6. Links to other sites

The Website contains links to third-party sites, such as our LinkedIn page and Google Maps. We do not control those sites and are not responsible for their content or their privacy practices. Linking to them does not mean we endorse them.

7. Availability and changes

We may change, suspend or remove any part of the Website at any time and do not promise that it will always be available or free of errors. We may also update these terms; the current version is always published on this page with its effective date, and continued use of the Website after a change means you accept the updated terms.

8. Liability

To the extent permitted by law, DynamicWhale is not liable for any loss or damage arising from your use of the Website or reliance on its content, including indirect or consequential loss, lost profits or lost business opportunity. Nothing in these terms excludes liability that cannot be excluded under applicable law, including liability for intent or deliberate recklessness.

9. Privacy and cookies

How we handle personal data is described in our Privacy Policy, and the cookies used on the Website in our Cookies Policy. Both form part of these terms.

10. Governing law and contact

These terms are governed by the law of the Netherlands, and disputes are subject to the exclusive jurisdiction of the courts of Amsterdam. This is without prejudice to any mandatory right you have as a consumer to bring proceedings in your own country.
